NJ Votes to Legalize Marijuana | What You Need to Know

New Jersey residents have voted to legalize marijuana. In fact, 66.91% of New Jerseyians voted in favor of legalizing weed. But, just because NJ residents have voted to legalize weed, doesn’t mean that it is automatically legal. Read on to learn more about the changes that may be made in the coming months.

Can I Buy Weed in New Jersey?

Currently, there is no legal way to buy marijuana in the state of New Jersey, aside from the medical marijuana program. Regardless of the vote to legalize weed, new laws have yet to be put in place. Lawmakers must pass new bills to decriminalize the possession of weed, and to establish industry rules and regulations.

Can I Still be Arrested for Weed?

In New Jersey, Marijuana possession of fewer than 50 grams could result in up to 6 months of incarceration and up to $1,000 in fines. Possessing more than 50 grams of marijuana may result in up to 18 months in prison and a fine of up to $25,000. As of now, this law still stands. If the legalization of marijuana is added to New Jersey’s constitution, those who are arrested for possession may be able to use that as a new legal defense. But, until new laws are passed, residents can still be arrested for breaking the existing laws.

Who Will the New Laws Apply to?

You will have to be 21 years or older to legally purchase weed in New Jersey. Those under 21 may still be arrested and charged for possessing marijuana.

What is the Timeline?

We are at the beginning of this process, and it may take some time before you really start to see any changes. NJ.com has stated that Massachusetts did not open its first dispensary until two years after voters approved legalization. In Maine, it took about four years to open dispensaries. Some predict that, if all goes as planned, dispensaries in New Jersey will open and begin selling weed by late 2021, or mid-2022.
